Terms & Conditions – GhostGPT

1. Introduction
Welcome to GhostGPT. By downloading, installing, accessing, or using the GhostGPT mobile apps, website, or related services (the “Services”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you must not use the Services.
2. Eligibility
You must be at least 13 years old (or the minimum digital age in your country, e.g. 16 in the European Economic Area).
If you are under 18 (or the age of majority in your region), you must have parental or guardian consent.
By using the Services, you confirm you have the legal capacity to agree to these Terms.
3. The Service
GhostGPT provides access to AI-generated conversational content.
We emphasise privacy and security: chats are encrypted and not stored on our servers.
We do not guarantee accuracy, availability, or suitability of any AI outputs.
Outputs may be inaccurate, misleading, or offensive.
4. No Advice Disclaimer
GhostGPT does not provide professional advice.
No medical advice: Do not use for diagnosis, treatment, or health decisions.
No legal advice: Do not use for legal interpretation or decision-making.
No financial advice: Do not use for trading, investment, or tax purposes.
No safety-critical advice: Do not use for emergency, security, or operational decisions.
You are solely responsible for how you use the outputs.
5. Accounts & Subscriptions
Some features require a paid subscription, purchased via Apple App Store, Google Play Store, or other authorised platforms.
Subscriptions automatically renew unless cancelled at least 24 hours before renewal.
Cancellations and refunds must be handled through your app store provider. GhostGPT cannot directly issue refunds.
Free trials may be offered. Abuse of free trials (e.g., creating multiple accounts) may result in suspension or termination.
6. Acceptable Use
You agree not to:
Use the Services for illegal purposes (e.g., fraud, harassment, defamation, exploitation, terrorism).
Attempt to reverse engineer, copy, or tamper with our software, encryption, or APIs.
Circumvent usage limits, caps, or subscription controls.
Upload or distribute harmful content (malware, viruses).
Use the Services in a way that risks harm to minors.
We may suspend or terminate your access immediately if you breach these terms.
7. Intellectual Property
GhostGPT, its brand, software, design, and all related intellectual property belong to Intelvia Ltd.
You are granted a personal, limited, non-exclusive, non-transferable license to use the Services for your own purposes.
You may not reproduce, distribute, or resell our Services without written permission.
8. Content Responsibility
You are responsible for your inputs and how you use outputs.
We do not claim ownership of your inputs, but by using the Services you grant us (and our processors) the rights necessary to process and deliver responses.
We are not liable for third-party content accessed through the Services.
9. Limitation of Liability
To the fullest extent permitted by law:
GhostGPT and Intelvia Ltd are not liable for damages of any kind arising from your use of the Services, including but not limited to direct, indirect, incidental, consequential, or punitive damages.
Our total liability to you shall not exceed the greater of:
(a) the amount you paid to us in the three months prior to the claim; or
(b) £50 GBP (or local currency equivalent).
10. Indemnity
You agree to indemnify and hold harmless Intelvia Ltd, its officers, employees, and partners from any claims, damages, liabilities, and expenses (including legal fees) arising from:
Your misuse of the Services.
Your violation of these Terms.
Your violation of any law or third-party rights.
11. Service Availability
We aim for reliable uptime but do not guarantee uninterrupted access.
We may suspend or modify the Services for maintenance, security, legal, or technical reasons.
We are not responsible for loss of data or content (note: we do not store chats).
12. Termination
We may suspend or terminate your access without notice if you violate these Terms.
You may stop using the Services at any time by cancelling your subscription and deleting the app.
13. Governing Law & Disputes
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.
If you are in the EEA, you may also have rights under mandatory local law.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory law provides otherwise.
14. Changes to Terms
We may update these Terms from time to time. If changes are material, we will provide notice (e.g., in-app or by email). Continued use after changes constitutes acceptance.
